This WEBSITE is managed by MKFT, LDA. (hereinafter, Atalaia Sol APARTHOTEL), tax ID: 510 974 856.
The current Terms and Conditions (hereinafter, “Conditions”), are applicable to all the website´s users or clients (hereinafter, “User(s)” and to any transactions of commercial nature performed through the platform.

2. INTRODUCTION
By using this website and/or perform any online booking, the User commits itself to the current Conditions and the other policies that rule the website´s use (namely, Privacy Policy). “Atalaia Sol APARTHOTEL” requests the careful reading of the Conditions and associated policies before using this website.

The current General Conditions rule the terms in which the services are offered to the clients. The eventual Particular Conditions of a determined service prevail over these Conditions and other expressly stipulated by writing between MKFT, LDA and the client prevail over those.

The contractual proposal regarding online accommodation is directed only to majority age people, with full capacity and that, therefore, can be accountable for the commitment generated from the buying and selling of the commercialized services.
In case the User does not agree, total or partially, with the current Conditions, should not access the website nor its associated functionalities and services. Specially, the execution of any online accommodation booking depends on the acceptance of these Conditions, therefore, not accepting them, one cannot use it.

The acceptance of these Conditions by the User is performed under his personal name. Furthermore, by accepting these Conditions, the User expressly declares that will not use the website and the functionalities or services associated to its use for illegal and/or illicit purposes.

“Atalaia Sol APARTHOTEL” can, at any time, update, change, substitute, total or partially, the current Conditions or the associated policies, by announcing such amendments in a proper place. The User is responsible for verifying periodically the occurrence of such amendments, being the website´s use managed by the conditions applicable to each access moment.

The access and continued use of this website after the publication of any updates, amendments or substitutions of the Conditions and associated policies, with exception of the Privacy Policy, constitutes an acceptance of and agreement with those updates, amendments or substitutions.

Without prejudice to the eventual amendments of these Conditions, will be applicable to each booking, the Terms and Conditions in force in the date of the respective confirmation.

By using this website, the User recognizes that its personal data will be treated by “Atalaia Sol APARTHOTEL”, above identified, and declares that all the provided information or data are true and correspond to the reality. “Atalaia Sol APARTHOTEL” cannot be accountable for the inaccuracy of the information provided by the Users in the website, being these fully accountable for its accuracy, completeness and updating.
All the information or personal data provided by the User will be treated in accordance with the established in the Privacy Policy.

3. WEBSITE´S USE
3.1. Service´s Availability
“Atalaia Sol APARTHOTEL is not responsible for the damages arising from interferences, interruptions, informatic viruses, malfunctions or disconnections of the operative system that may obstruct, temporarily, the access, navigation or the provision of services to the Users.

“Atalaia Sol APARTHOTEL” (and/or its representatives or employees) can never be accountable for any damage arising from, in any capacity, the malfunction of this website, regardless how long does such malfunction last, or for the eventual damages caused by the reproduction, use or operation of the website that violates the dispositions of the current Conditions.


“Atalaia Sol APARTHOTEL” reserves the right to modify at any time the information and commercial offer presented about: services, prices, promotions and commercial conditions.

“Atalaia Sol APARTHOTEL” has the exclusive right to, unilaterally, at any time and without need of previous notice, suspend or end, partial or totally, temporarily or definitely, the access to the website, particularly the management operations, maintenance, repair, change or modernization.

The violation of the provisions of the Conditions by the User constitutes grounds for its termination by “Atalaia Sol APARTHOTEL”, who reserves the right to, at any time, end the use of the website and respective functionalities and services by the User in question, with or without notice. In any case, the violation of these Conditions by the User, and regardless the execution or not of its termination, gives “Atalaia Sol APARTHOTEL” the right to compensation by all the damages arising from it.

3.2. Online booking
i) General Conditions

3.2.1 The current general conditions rule and are an integral part of the provision of services’ contract signed through the website (“Website”) between MKFT, LDA. (hereinafter, Atalaia Sol APARTHOTEL), tax ID: 510 974 856 and the client that signs the contract (“Client”), that has the provision of touristic accommodation services (“Accommodation”) (“Contract”) as object.

3.2.2 The celebration of the Contract, happening after the confirmation of the booking through the Website, is done under the terms of these General Conditions, whose knowledge and acceptance by the Client are manifested through the validation of the selection box for the effect in the booking form, also being the Client aware of the Privacy Policy.

3.2.3. In the scheduling of any booking, the Client must fill correctly the respective form, indicating, namely, the check-in and check-out dates, the type of accommodation desired and associated complements, and the indication of the number of people, with the specificity of children and babies that will occupy the accommodation, always subject to availability’s confirmation by the “Atalaia Sol APARTHOTEL”, as well as their personal data and payment information, being fully accountable for the choices performed and for the provided information, that must be completed, true and updated.

3.2.4. With the confirmation of the booking data by the Client, a reservation code is given to him, sent to the indicated email address, which must be referred in all contacts with “Atalaia Sol APARTHOTEL”, acquiring the Client the right to the Accommodation services contracted with “Atalaia Sol APARTHOTEL”, in the terms and conditions described in the respective proof of booking and in the Contract, after the payment in the terms of the section iv) (Payment).

3.2.5. The Client in fully responsible for the acquisition and/or hiring of transportation that allows him to benefit from the contracted services.

3.2.6 Likewise, the Client assumes full responsibility for the possession and/or acquisition of the necessary documents (such as identification documents, authorizations, visas and vaccines certificates) for the entrance in the country and/or city of the APARTHOTEL where the accommodation is located, and should inform themselves in time about this matter. “Atalaia Sol APARTHOTEL” does not assume any responsibility for the rejection of visa issuance or entrance permits to the Client in the country, being applicable, in this case, the provisions of section viii) (cancelations).


ii) Accommodation and Price

3.2.7. The APARTHOTEL and Accommodation characteristics are those displayed in the reservation. However, since the APARTHOTEL photographs weren´t taken in the day of the client´s booking, there might be some non-substantial differences between the photograph and the reality by the date of enjoyment of the services contracted by the Client, that do not grant the Client the right to any change in the Contract.

3.2.8. The prices are presented by room, however they might be presented according to other categories, that in any case will be duly indicated in the Website in the moment of the booking execution. In case it is possible to perform a booking for a number of people superior to the Accommodation´s normal capacity, an extra bed might be needed to be placed, which may not provide the same comfort and quality as the rest of the Accommodation beds, reducing its usable area. The extra bed can only be used by children up to 12 years old.

3.2.9 The stay of children up to 2 years old is not charged, as long as they stay in the same accommodation unity of the adults responsible for them. The stay of children from 3 to 12 years old in extra bed in charged. However, the client should always inform the “Atalaia Sol APARTHOTEL” about the addition of children in its booking. The booking acceptance may be subject to the number of available cribs and extra beds, as well as the space available in the accommodation unit.


3.2.10 The food provision and its specificities, namely the prices, are communicated to the Client, through the Website, in the moment of a booking execution.

3.2.11. In case nothing is mentioned in the booking, it will only include the accommodation, not being expected any included food provision.

3.2.12. In case the Client presents himself with more people than the indicated in the reservation to use the Accommodation, the APARTHOTEL´s responsible can refuse their entry, not being the “Atalaia Sol APARTHOTEL” accountable for this situation.

3.2.13 Anytime there are reasons that justify it, the accommodation unit can be replaced by another of same or higher quality, through written agreement with the client and without increase in the price paid by the client.

3.2.14 As a matter of course, the Accommodation can be used from 2pm of the arrival’s date and must be left until 11am of the departure’s date (in both cases, at the APARTHOTEL´s local time). The permanence in the Accommodation besides the check-out time may lead to the payment of additional amounts, being the client´s exclusive accountability. However, there might be allowed exceptions, as long as they don’t affect other reservations and/or the cleaning of the accommodation unity.

3.2.15. In case the Client does not show up in the APARTHOTEL until the time informed in the reservation of the entry date indicated in the receipt, the APARTHOTEL may disregard the reservation and sell the Accommodation to third parties and can´t be accountable for that.

3.2.16. The Client must comply with the internal regulations of the APARTHOTEL´s use, in case it exists, not being the “Atalaia Sol APARTHOTEL” accountable for the losses suffered by the Client in consequence of its violation.

iii) Promotions and Discounts

3.2.17 “Atalaia Sol APARTHOTEL” can perform in the Website, with temporarily limited scope or not, certain promotions (“Promotions”) and discounts (“Discounts”) in the reservations performed by its Clients.
3.2.18 The following conditions are applicable to the Promotions and Discounts:

a) For the benefit of certain Promotions and/or Discounts, it may be requested to the Client the introduction of a promotional code (“Promotional Code”) or the reservation´s anticipated payment;
b) Promotions and Discounts are subject to availability´s confirmation;
c) APARTHOTEL Atalaia Sol reserves the right to cancel the Promotions and/or Discounts or to reject a Promotional Code when the total amount of the Promotional Codes already used exceed a certain financial amount or when they are used fraudulently (namely, by those who are not their holder/beneficiary).
d) The Benefits, Promotions and Discounts are only valid for bookings performed through the Website and are not transmissible to third parties;
e) In case of cancelation or non-use of a booking made in the scope of a Promotion or Discount, it will not be reimbursed the amount of the Promotion or Discount, nor guaranteed its reapplication in another booking;
f) In case of change, by Client´s initiative, of the characteristics and/or ownership of a booking performed in the scope of a Promotion or Discount, the Client can lose the benefit/perk granted by the booking, being applicable, in case of waiver, the provisions of section viii) (cancelations);
g) The use of fraudulent mechanisms to obtain the Promotions or Discounts holds the customer liable in the general terms and provides “Atalaia Sol APARTHOTEL” the right to choose between (a) the applicability of the non-discount fee and (b) the Contract´s termination, being that termination equated with the termination of the Contract by the Client in the terms of the clause 10.1, regarding the consequences arising from it, without prejudice of the right of the “Atalaia Sol APARTHOTEL” being compensated for all the suffered damages;
h) “Atalaia Sol APARTHOTEL” reserves the right to cancel and/or change at any time the Promotions and Discounts.
iv) VAT

3.2.22 The reservation final prices already include VAT, at the current legal rate.

v) Payment

3.2.23 The Client must pay the amount indicated in the booking form as previous request in order to be able to enjoy the contracted reservation.

3.2.24 The reservation´s payment can be made by the Client (i) in the Website, on the date of the execution of the booking or (ii) in the APARTHOTEL, in the date of entry in the Accommodation (in case this category is available for the type of reservation made by the Client). Typically, is demanded the payment of 50% of the reservation´s amount, in the date of booking. It might be requested a superior amount according to the season of the year or a promotion´s usufruct. In any case, it may or not exist the reimbursement of the amount paid, according to the cancelation policy presented in the booking form.

3.2.25. The online payment must be done through a credit card of your ownership, within the list of issuing entities with whom APARTHOTEL Atalaia Sol cooperates with and that is displayed in the booking form, being the payment accepted by the APARTHOTEL within the limits authorized by its issuing entities.

3.2.26. The payments made in person can only be done in the terms allowed by the APARTHOTEL, therefore, the client check in time with the APARTHOTEL about the accepted forms of payment.

3.2.27. It is applicable the following payment policy:
Direct reservations made 35 days or more before check in: Payment of 50% of the reservation (deposit) in the moment of the booking and the remaining in the check-in;
Direct reservations made less than 35 days before check-in: full payment in the moment of the reservation
Packs: payment of 50% in the moment of the reservation and the remaining in the check-in
Last Minute (reservations made less than 7 days before check-in): full payment in the moment of the reservation
vi) Changes

3.2.28. Any changes in the reservation made requires the express agreement of “Atalaia Sol APARTHOTEL”, that may imply changes in the price and/or being subject to the payment of rates, calculated according with the type of reservation, the date of the change and the applicable fee.

vii) Cancelations

3.2.29. The Client is free to give up or cancel the accommodation reservation at any time.

3.2.30. Regarding the reimbursement, is applicable the following:
Direct reservations made 35 days or more before check in: refundable in 50% if cancelled at least 7 days before check-in;
Direct reservations made less than 35 days before check-in: refundable in 50% if cancelled at least 7 days before check-in;
Packs (Valentine´s, Easter, Halloween, New Year, Honey Moon): refundable in 50% if cancelled at least 7 days before check-in;
Last Minute (reservations made less than 7 days before check-in): non-refundable.
viii) Impossibility of Enforcement

3.2.33. When, by facts non-imputable to “Atalaia Sol APARTHOTEL”, “Atalaia Sol APARTHOTEL” could not comply with the obligations arising from the Contract, it must notify the Client immediately of such impossibility. If that impossibility is an essential obligation, the Client can cancel the Contract without any penalty or accept by written an amendment to the Contract and eventual price variation. The Client must communicate to APARTHOTEL his decision within 4 days after the reception of the notification from “Atalaia Sol APARTHOTEL”, meaning he agrees with such change in case of no reply.

3.3. Complaints
3.3.1. APARTHOTEL Atalaia Sol has an online and physical complaints book, therefore, in case you wish to present a complaint about the service provided to you, you should request such Book at the Reception of the APARTHOTEL or access the website www.livroreclamacoes.pt.

3.4. Alternative Dispute Resolution
3.4.1 Under the terms of the Lei n.º 144/2015 de 8 de Setembro, the Client can also appeal to the Alternative Consumer Dispute Resolution Entities duly indicated in the list provided by the “Direção Geral do Consumidor” in www.consumidor.pt whose consultation we henceforth suggest.

3.5. Guarantees
3.5.1 Atalaia Sol APARTHOTEL´s civil liability , emerging from the obligations assumed towards the Client, is guaranteed by a civil liability´s insurance contracted with the insurance company “Açoreana”, with the policy no. A400030484 and commercial premium in the amount of EUR 2,811.05, in the terms and with the exclusions established in the applicable legislation.

3.6. Personal Data
3.6.1 In the filling of the booking form, will be requested to the Client certain data susceptible of identifying him (“Personal Data”), that will be collected and treated by “Atalaia Sol APARTHOTEL”, in the strict law compliance and in accordance with the provisions of the website´s Privacy Policy.

3.6.2. “Atalaia Sol APARTHOTEL”, as controller, respects your privacy. All and any personal data collected in the website will be kept confidential and will not be sold, communicated or, in any way, re-used by third parties without your consent.

3.6.3 Any personal data that are provided to us will be treated according with the relevant legislation, with best practices and ensuring all the technical and organizational security measures for the protection of such data, being these used with the purpose of execution of the contract and to improve your experience in our website. 3.7. Communications and Notifications
3.7.1 All the communications or notifications in the scope of the Contract must be performed using the information provided by the client through the online form. 4. Terms and Conditions Amendments
“Atalaia Sol APARTHOTEL” reserves the right to change or update the current Terms and Conditions regarding the use of the reservation services without notifying the Client. The current version of the Terms and Conditions will be published in the website from the day of its entry in force. By continuing to use the website after the amendment of the current Terms and Conditions, you accept such amendments. The eventual changes will not affect the reservations already made.

5. Legal framework
These Terms and Conditions constitute a contract between the client and “Atalaia Sol APARTHOTEL”.

If any party or provision of the current Terms and Conditions is considered null or ineffective, the remaining provisions will remain in force, not being affected its global validity, unless is possible to conclude that the parties would not have agreed in the provision of the service if they would predict the nullity or ineffectiveness of such provision.

To all emerging disputes of the interpretation or execution of the current General Conditions will be applicable the Portuguese legislation. The client agrees that, if not appealing to any of the alternative dispute resolution methods described in 3.4., any dispute will be solved by the Judicial Court of the Judicial District of Lagos, in accordance with the Portuguese law.
